LINCOLN -- Lawyer Shelly Barnhart took the oath of office Tuesday evening to become the new representative of Ward 4 on the Lincoln City Council. Council members appointed Barnhart on Aug. 5 to complete the term of longtime Councilman Kurt Kuykendall, who died July 6.

Barnhart, who specializes in criminal and juvenile law, has lived in Lincoln for nearly 20 years, and opened her law practice in the city in 2007.

She will become president of the Talladega County Bar Association in October.

Swearing Barnhart into the office was the City Council's first order of business in a meeting Tuesday night. During Barnhart's first meeting, a Lincoln resident addressed the council about making the new library more easily accessible.

"The new library has a curb that makes it difficult for people with mobility issues to access the library," said Gene Hollon. "They have to go around to the side and up the ramp, then back and halfway down the building to the front entrance, which is a great imposition in inclement weather. This makes the library inaccessible to many citizens. I have three friends who can't access it."

Hollon said he would ask the council to consider cutting the sidewalk in front and creating a sloping ramp for easy access and placing handicapped spaces on either side.

Mayor Bud Kitchin said the new library is in compliance with the Americans with Disabilities Act.

"The striping and signage isn't in place yet because there is some asphalt removal needed due to a drainage issue," he said. "It was originally designed for handicapped access out front, but that area is elevated and doesn't comply with ADA code. Per our architect's advice, we built the ramp on a flat area."

Kitchin said he discussed the idea of creating an additional ramp near the front of the library with the architect.

"We could do it, but we wouldn't be able to label it as handicapped-accessible or put handicapped parking spots adjacent to it," he said.

In other matters Tuesday, the council:

O Annexed property owned by John and Lynn Burns at 1140 County Park Lane, Talladega.

O Rezoned property owned by Logan Martin Resorts LLC at 44200, 44150 and 44100 U.S. 78 from R-3 to B-1.

O Amended the FY-2014 budget in the amount of $41,654 for the following budget categories:

o WWTP - #358 Sewer Testing & Analysis $12,395.

o Clerk - #366 Repairs & Maint-Bldgs/Land $15,000.

o Clerk - #212 Computer Software/Hardware $7,000.

o Clerk - #850 Miscellaneous $7,259.

O Approved having S&R Paint & Body Shop paint the city’s 2008 Ford E-350 ambulance for $4,876.35.

O Approved spending $1,500 to have Gilreath Printing & Signs install lettering on the 2008 Ford E-350 ambulance.

O Amended the FY-2014 Budget in the amount of $6,726.35 for the following budget category:

o Fire & Rescue - #362 Repair & Maint - Motor Vehicles $6,826.35.
