A Calhoun County judge on Wednesday set a trial date for a man charged in the 2011 death of a Wellborn teacher.
Tyrone Thompson, 33, was charged with capital murder, robbery and kidnapping in connection to the stabbing death of Kevin Thompson. Jovon Gaston and Nick Smith were also charged in connection to Thompson’s death. Smith was convicted and sentenced to death in a July 2013 trial, while Gaston was convicted and sentenced to the same in October 2015.
On Wednesday, Circuit Judge Debra Jones moved to set the nearly seven-year-old case for trial. According to previous hearings, there have been questions about Thompson’s competency to stand trial.
Jones set the case to go to trial in late September.
“Taking into account the schedules of the attorneys and this court’s schedule, Sept. 24 is the last week I can plan for a two-week capital murder trial.” Jones said.
Fred Lawton, one of Thompson’s attorneys, said he and attorneys Nancy Vernon and Warren Freemen should be able to meet that deadline.
“We’ve talked with all of our experts,” Lawton said. “If everything falls into place, we can meet that.”
