NOTICE OF MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain Mortgage executed by Jerry W. Allred Jr., Tammy L. Allred, husband and wife, to Mortgage Electronic Registration Systems, Inc. ("MERS"), (solely as nominee for Lender, New South Federal Savings Bank, and Lender's successors and assigns), dated the 31st day of August, 2009, which Mortgage was recorded in the Office of the Judge of Probate of Calhoun County, Alabama, in Mortgage Book 4559, at Page 339; said Mortgage having been duly transferred and assigned by Mortgage Electronic Registration Systems, Inc. (solely as nominee for Lender, New South Federal Savings Bank, and Lender's successors and assigns) to Alabama Housing Finance Authority by virtue of that certain Assignment of Mortgage dated March 6, 2019 and recorded in said Probate Office in Mortgage Book 4901, at Page 974. The undersigned Alabama Housing Finance Authority as Assignee of said Mortgage will, under and by virtue of the power of sale contained in said Mortgage, sell at auction to the highest bidder for cash before the main entrance of the Calhoun County Courthouse in the City of Anniston, Alabama, during the legal hours of sale on May 23, 2019, the real property described in said Mortgage, which said description is hereby referred to and made a part hereof, said property being situated in Calhoun County, Alabama, to-wit: A parcel of land in Section 33, Township 15 South, Range 9 East, containing 1.5 acres, more or less and being more particularly described as follows: Commencing at an existing pipe marking the Northeast corner of said Section 33; thence S 01 degrees 31' 32" W 540.11 feet to an existing 5/8" rebar; thence S 01 degrees 30' 06" W 538.24 feet to an existing 1/2" rebar at the Northeast corner of that parcel recorded at Book 1595, Page 299; thence N 89 degrees 26' 23" W 806.67 feet along the North line of that Parcel recorded at Book 1595, Page 299, and the South line of that Parcel recorded at Book 1591, Page 594, to an existing 1/2'' capped re-bar (HUTTO) at the southwest corner of Wayne Geir's property and the point of beginning of the hereinafter described parcel; thence S 08 degrees 54' 21" E 84.39 feet to a 1/2'' capped re-bar (HUTTO) set on the Northerly line of Cross Creek Road; thence Southwesterly along the Northwesterly line of Cross Creek Road on a chord bearing of S 46 degrees 02' 38" W 158.79 feet to a 1/2''capped (HUTTO) re-bar set; thence continue Southwesterly along the Northwesterly line of Cross Creek Road on a chord bearing of S 29 degrees 02' 42" W 195.65 feet to a 1/2'' capped (HUTTO) re-bar set; thence continue Southwesterly along the Northwesterly line of Cross Creek Road on a chord bearing of S 46� 12' 18" W 102.33 feet to a 1/2'' capped (HUTTO) re-bar set; thence N 0 degrees 43' 05" E 418.36 feet to a 1/2'' capped (HUTTO) re-bar set on the North line of that property described at Book 1595, Page 299; thence S 89 degrees 26' 07" E 267.95 feet back to the point of beginning.
