On July 27, outgoing Councilman Ben Little was charged with violating the Council-Manager Act for allegedly ordering Anniston Street Department employee James Fluker to retrieve a copy of a surveillance video from his supervisor’s desk for him. According to the Council-Manager Act, the state law that outlines the duties and powers of local elected officials, individual council members are not allowed to direct city staff.
The trial got underway Tuesday morning but was interrupted when Fluker had a seizure on the witness stand. While prosecutors were able to call all of their witnesses, Little’s defense attorney, Raymond Johnson, said he would be unable to call his witnesses until Fluker had finished testifying.
District Judge Mannon Bankson rescheduled the trial for 9 a.m. Friday, pending Fluker’s recovery.
