It seems like the Macdonald Farms Homeowners Association has recourse against the city of Springville for dropping the ball ("Mayor: City to make decision soon on legal action for subdivision roads," Sept. 19).
Surely, as the city’s counsel states, "the problem is rampant and cases are multiple" and the applicable municipalities would be aware of surety bonds and their expirations. If inaction impacted standing, the city should handle the road issues.
Do the residents of MacDonald Farms pay taxes? Public officials are compensated from said taxes.
If the HOA takes legal action, changing the venue might be appropriate; note the name of the city’s counsel and a prominent county judge.
