Sylacauga man pleads guilty to murder

A Sylacauga man was sentenced to 26 years in prison after pleading guilty to murder, Assistant District Attorney Jake Argo said.

Robert Charles Pate III, 54, also pleaded guilty to assault in the first degree, and was sentenced to 20 years in prison on that count. Both pleas were accepted by Circuit Judge Bo Hollingsworth, who also handed down the sentences.

Pate was driving a 1989 Oldsmobile Ciera on the Sylacauga-Fayetteville Highway in November 2012 when he collided with a 2001 Toyota 4Runner. Pate was intoxicated at the time.

Christin Leigh Thrash, 19, a passenger in the 4Runner, was pronounced dead at the scene. 

The 4Runner was being driven by Tisha E. Pate, 42, no relation to Robert Pate. Tisha Pate and Burnice Allen Morris, 32, of Jemison, were both injured and transported to the emergency room of  Coosa Valley Medical Center. Robert Pate was transported to University of Alabama Birmingham Hospital.

Curtis Pate, 8, and Myra Morris, three months old at the time of the accident, were also passengers in the 4Runner. 

According to Assistant District Attorney Christina Kilgore, Thrash had unfastened her safety belt to get something for her baby in the back seat at the time of the collision.

Also in court this week:

• Circuit Judge Julian King sentenced Christopher Michael Harper, 26, to 15 years, split, three years in prison and three years probation, for robbery in the first degree.

• King sentenced Spencer Lamar Tyson, 39, to 15 years, split, 465 days in prison and 36 months probation, for kidnapping in the second degree. A count of kidnapping in the first degree was dismissed.

• King sentenced Cody Madison Carlton, 21, to 36 months, reverse split, 18 months probation and nine months in prison, for six counts of burglary in the third degree.

• King sentenced Michael Termain Millender, 37, to five years, reverse split, six months in prison and 36 months probation, for violating the sex offender notification act. A similar count was dismissed as mutually exclusive.

• King sentenced Cory Neil Farmer, 22, to 60 months, suspended, 36 months probation, for distribution of a controlled substance.

• King sentenced Colby Delane Craighead, 23, to 28 months, reverse split, 18 months probation and nine months in prison, for theft of property in the second degree.

• King sentenced Justin Roshund Welch, 25, to 10 years in prison for escape in the third degree.

• King sentenced Kecia Marie Davis, 29, to 36 months in prison, suspended, 36 months probation, for possession of a controlled substance and possession of marijuana in the first degree.

• King sentenced Patrick Shawn Wells, 32, to 55 months in prison for manufacture of a controlled substance in the second degree. A drug paraphernalia charge was dismissed.

• King sentenced Javier Francisco Sanchez, 26, to 24 months, suspended, 36 months probation and six months, suspended, six months probation, for possession of a controlled substance and possession of marijuana in the second degree, respectively.

• Felix Crayton, 50, failed to appear.

• King sentenced Patti Lanell Pugh, 39, to 60 months, suspended, 36 months probation, for distribution of a controlled substance.

• Hollingsworth sentenced Christopher Wayne Tipton, 30, to five years, suspended, three years probation, for criminal mischief in the first degree.

• Hollingsworth sentenced Christy Lightsey, 33, to 36 months, suspended, three years probation, for burglary in the third degree.

• Hollingsworth sentenced Frederick Reed, 36, to 126 months each for breaking into and entering a motor vehicle and fraudulent use of a credit or debit card.

• Hollingsworth sentenced Candace Spanks, 25, to 12 months, suspended, two years probation, for possession of marijuana in the second degree. Spanks was originally charged with possession of marijuana in the first degree but pleaded to the lesser charge.

• Hollingsworth sentenced Anthony Benn, 24, to 30 months in prison for possession of a controlled substance.

• Hollingsworth sentenced Terry Embry, 26, to 180 months for robbery in the second degree.

• Hollingsworth sentenced John Eddie Garrett Jr., 47, to 95 months each for burglary in the third degree and two counts of possession of a controlled substance.

• Hollingsworth sentenced Greg Hallman, 31, to 56 months, three years probation for manufacture of a controlled substance in the second degree.

• Hollingsworth sentenced Casey Barnett, 28, to 39 months in prison for possession of marijuana in the first degree.

• Hollingsworth sentenced Stephanie Diaz, 33, to 30 months, suspended, three years probation, and 12 months, suspended, two years probation, for possession of a controlled substance and possession of drug paraphernalia.

• Hollingsworth sentenced Misty Shelnutt, 33, to 42 months, suspended, three years probation and 12 months, suspended, two years probation, for possession of a controlled substance and possession of drug paraphernalia.

• Hollingsworth sentenced Stephen Stover, 23, to 56 months, suspended, three years probation, for manufacture of a controlled substance in the second degree, 48 months each on two counts of possession of a controlled substance and felony drug paraphernalia, and 12 months each, suspended, two years probation, for possession of marijuana in the second degree and possession of drug paraphernalia.

• Hollingsworth sentenced Brentavies Marizzette, 31, to 56 months in prison for distribution of a controlled substance.
