Judge rules in school board’s favor in lawsuit over hiring of superintendent

A circuit court judge has ruled in favor of the Anniston City Schools and its hiring Superintendent Joan Frazier.

Judge John C. Thomason said state law and an attorney general's opinion backed the board's decision to hire Frazier without advertising the position, and also ruled that the school did not violate the open meetings act.

In May, the Birmingham education reform group Citizens for Better Schools sued the school board, claiming it had violated the Open Meetings Act by meeting secretly before the meeting at which Frazier was hired.

The board hired Frazier, who had served as interim superintendent for seven months, on April 24.

“It’s a shame the school board had to spend the time and money to defend this case,” said Burgin Kent, the school board attorney.
