Anniston BOE responds to Felton’s lawsuit

The Anniston Board of Education wants a judge to decide what it owes former Superintendent Sammy Lee Felton and also decide how he will be paid, the board’s attorney says.
The board responded Friday to a lawsuit filed against it by Felton in March. Felton, whom the board fired last year, wants $250,000, plus additional money for interest, costs and attorney’s fees. The board fired him over a dispute about the firing of an assistant principal at Anniston High School. Felton’s lawsuit requests the board pay him in one lump sum for the rest of his contract, which ends in 2009. His at-torney says the total he’s due for one year’s salary and benefits is $157,849. That amount does not include other claims in the lawsuit. In his response Friday, the board’s attorney Carl Johnson disputes some of the money Felton says he’s entitled to and asks the board to continue to make monthly payments to Felton for the rest of his contract. “The lump sum payment apparently sought by Dr. Felton would also work an unnecessary and unreasonable hardship on (the school board) as it would require an extraordinary and unanticipated expenditure that could work to the sub-stantial detriment of the system’s financial operations,” Johnson wrote. Attempts to reach Felton’s attorney today have been unsuccessful. |
